1. MAKING A CONTRACT WITH US

1.1 When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order.

1.2 Once the payment has been successfully made for your order we will e-mail you to confirm that we accept your order, and that a contract has been made between us.

1.3 In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us. If, by mistake, you already received a confirmation e-mail that we accepted your order, we will send you cancellation e-mail and reimburse you the amount you paid to us in full.

1.4 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured furniture. Whilst goods may be shown assembled they may require assembly by you.

1.5 We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the actual goods. This is why we recommend that you order our fabric samples firstly, it’s FREE!

1.6 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

1.7 This contract is covered by English law.

1.8 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

2. HOW TO PLACE ORDER

2.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

2.2 Delivery charges will be shown prior to you placing your order.

2.3 You will be required to pay for the goods in full at the time of ordering.

2.4 We use secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard or any other major credit card or PayPal. You can also pay us via direct bank transfer.

2.5 Promotional prices only apply during the period stated.

2.6 All prices quoted on our website are in UK pounds including Value Added Tax at the current rate. You can also select other currencies such as EUR and USD. Prices will change accordingly.

2.7 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

2.8 Once your order is complete we will notify you of the dispatch date.

3. DISCOUNT COUPONS

3.1 Discount coupons are personalized codes, also referred to as CoverCouch Discount Codes, which allow you to take advantage of a discount on your purchase on CoverCouch.com.

3.2 The CoverCouch Discount Codes input field is displayed on page „Shopping Cart“ after you have added your chosen items into the basket. Only one Discount Code can be used per order. Each Discount Code is individual: it may have a number of use limitations, time limitations, etc. These are provided to each client whom such a code has been issued by CoverCouch.

4. DELIVERY AND CARRIAGE CHARGES

4.1 We manufacture all products on order basis. Please allow approximately 2-3 weeks for your order to be produced after you place your order and it has been paid. Any estimated dispatch date is a an estimate, which can change without notice.

4.2 We will normally deliver goods within 3-5 working days of dispatch. We dispatch our goods via UPS courier company.

4.3 Your order may arrive in more than one delivery.

4.4 Delivery charges depending on your destination country will be shown prior to you placing your order.

4.5 We can deliver our covers anywhere in mainland Great Britain and almost anywhere in the rest of the world. Please select your country from countries dropdown list during the checkout. If you can't find your country in that list, unfortunately we do not deliver to your destination, however we are able to find a solution for you, please contact us at [email protected].

4.6 We will deliver the goods to the premises you specify on your order. You must be at home (or at the specified shipping address) to accept delivery of your order, which is normally between 8:00am and 5:00pm Monday-Friday. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended.

4.7 Disposal of packing materials is your responsibility.

4.8 After two failed delivery attempts (or if you are not at home for an agreed delivery) the goods may be returned to the factory and we reserve the right to charge you an additional re-delivery charge.

4.9 If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery.

4.10 Please check the goods on delivery - any goods found to be missing or damaged should be notified to the delivery driver at the time of delivery or ourselves within a reasonable time.

4.11 If the goods are lost or damaged in transit, please let us know promptly.

4.12 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We will try to put things right as soon as possible however we can’t be responsible where this causes a delay or failure in delivering your goods.

4.13 Time is not the essence of the contract unless expressly stated otherwise in writing by a Director of the Company.

4.14 Your order may be subject to import duties which are levied once your package reaches your country. CoverCouch ships your package DDU, "duties and taxes unpaid", does not collect your local duties, and cannot accurately predict what your particular charges may be. UPS processes the shipment through your local Customs office for you, so you don't have to waste valuable time dealing with the complexities of local Customs clearance. If a Customs duty applies, the UPS driver will collect these fees directly from the recipient upon delivery. Please note: the driver might refer to the fee as a COD. Rest assured that CoverCouch has already paid all shipping fees; the COD is only ever made up of processing fees by local governmental Customs (these differ from country to country and even from government to government). If paying the driver by check, the check is to be made out to UPS according to their instructions. For more information regarding your country's customs laws, please contact your local customs office. The origin of shipment is the European Union.

5. CANCELLATION AND RETURNS

5.1 We will accept cancellation of your order for items that have not shipped. Once products ship from the production plant, all sales are final.

5.2 Due to the nature CoverCouch products being personalized and custom made, we cannot accept returns or offer exchange because of wrong colour or fabric structure or due to change of mind. For instance: Your blue fabric doesn’t match my white wall or the color of the fabric doesn't look the same as on computer screen. Please Order Free Fabric Samples first.

5.3 Tailor-made goods including but not limited to furniture covers can be accepted for a refund only when the goods are faulty.

5.4 In the event that the products are returned to our production plant without fault on our part, a 15% restocking fee from the entire purchase price will be applied.

5.5 If you want to return anything, contact CoverCouch customer service by emailing us at [email protected] within 14 days after the day of delivery.

5.6 Returned item(s) need to be unused and in their original state.

5.7 Returned item(s) need to be sent back to CoverCouch within 30 days from the date you received the package.

5.8 Please note it is your responsibility to pay for return shipping.

5.9 If you’re missing any of the points from this list, unfortunately we won’t be able to offer you a return.

5.10 If your product has a manufacturing defect i.e., holes, broken zipper, tears - or if it doesn't fit, please read FAULTY GOODS / GUARANTEE section.

6. FAULTY GOODS / GUARANTEE

6.1 If there is a problem with the goods, please notify us by email or in writing providing details of the problem within 14 days after the day of delivery. Its helpful if you can provide us with a digital photograph of the problem as this normally saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.

6.2 All goods are covered by a manufacturer's warranty against faulty workmanship and materials, subject to the terms and conditions of that warranty.

6.3 The manufacturer's warranty is provided in addition to the rights that the law says you have as a consumer and accordingly, your statutory rights are not affected.

6.4 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received at our warehouse and checked. The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

6.5 Covers are guaranteed against materials and workmanship defects for a period of 1 year.

6.6 Covers should be taken care of in accordance with our care and maintenance instructions.

6.7 Within this time scale we will replace defective goods free of charge, at our discretion, providing that you have returned to us any faulty goods upon request.

6.8 If an item is no longer available we will offer an alternative. However our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance you will have the option of a refund.

6.9 Where we replace faulty goods you are responsible for their disposal if they have not previously been returned to us.

6.10 We are unable to guarantee and exact colour match due to the nature of the product.

6.11 All products are manufactured within tolerances of +/- 1.5mm.

7. LIABILITY

7.1 The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the uk.

7.2 We do not accept liability for any consequential loss of profit or indirect losses. You should therefore not book installation of the goods until you have received them and inspected them.

8. TRADE OR BUSINESS CUSTOMERS

The following conditions apply to orders placed by Trade or Business Customers.

8.1 Orders may not be cancelled except with our mutual agreement and having been confirmed in writing by a Director or our company. We reserve the right to make cancellation and/or re-stocking charges.

8.2 Claims for missing or damaged items must be made within 2 days of delivery.

9. LAW AND JURISDICTION

This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England.
